My Second Amendment
The Constitution is the greatest achievement of man to date in defining a government to sustain Liberty for its people. Governments exist between two poles of thought. One pole is the Government is all important and powerful and people exist to serve the Government (slave). The other pole is People create governments to protect their Rights (free). See the Declaration of Independence paragraph two.
In the United States people calling themselves progressives seek to change the Constitution, outside the legitimate amendment process, through laws and judicial decisions and presidential executive orders in order to move our government toward the slave pole. These progressives are in realty regressive and their agenda is to destroy our Liberty. These people do not like and are afraid of the Second Amendment and have put spin upon the meaning of the Second Amendment in order to blunt its impact and value.
A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
United States Constitution, Amendment II.
The English structure of the Second Amendment is first the reason, followed by the description of the Right, and finally the command to government.
First look at the description of the Right. The Second Amendment recognizes the Right of the people to possess and carry Arms. Arms are weapons of defense and the Right to own these Arms is part of the Right of self defense.
Second look at the command to government. This Right shall not be infringed upon by government. Under the Constitution, our government has no authority to restrict or suspend the Right of the people to possess Arms under any conditions; not even war or national emergency.
Third look at the reasoning for the Amendment. The presence of an armed population is a necessary factor for the security of a free nation. The scope of the Arms is articulated by the purpose to which these Arms could be used. In this case Arms would be whatever is appropriate for a Militia to use.
For many the thought of guns in the hands of their fellow citizens brings up visions of unrestricted daily violence on their otherwise peaceful streets. However these same people do not scream or faint when an armed police officer comes into their presence. Just receiving a ticket puts a citizen face to face with a gun toting individual. Our military carries weapons. Airport security carries weapons. Foreign airports have military personnel with automatic weapons walking around. None of these situations seem to cause gun control advocates to faint or even complain.
The Right to keep and bear Arms is the Right to defend one's self from other individuals, to defend one's self from multiple individuals, to defend one's family, even to defend our country from foreign invasion. However, it should be noted, using Arms for criminal activities is not a Right and would cause such an individual to lose his Right to Arms in the same manner as a murderer might lose his Right to life.
A government dedicated to liberty will see an Armed population as an asset. A government against liberty will want to control guns. The Constitution was designed to promote the liberty of the American people. The Second Amendment provides the legal basis for an Armed population.
Gun laws that restrict the ability of citizens to keep and bear Arms are unconstitutional and should be abolished. Arms are for defense and are military in nature. The idea that hunting or target shooting should define the scope of allowable weapons is Spin that is not supported by the clear language of the Second Amendment. Neither is the idea that the Second Amendment only applies to people who are in an organized or recognized Militia. The Second Amendment prohibits government from infringing, under any condition, upon the Right of the People to militarily defend themselves, their families, and their country.
This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.
The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.
United States Constitution, Article VI.
The ability to keep and bear Arms, including ammunition, is a vital part of maintaining our liberty. Those legislators who write gun laws contrary to the Second Amendment do so without Constitutional authority and in violation of their oath of office. Those judges who enforce unconstitutional gun laws do so unlawfully in violation of their oath of office. We must promote an understanding of our Constitution in order to benefit from the provisions it contains. We must protest government deviations from the supreme Law of the land until our voices are heard. We must be active to save our Liberty and defend our Constitution from the onslaught of governmental agendas.
Finally I would like to point out that the Bill of Rights only covers some of our more important Rights. The Bill of Rights is neither a complete list of our Rights nor was it intended to limit our Rights to just those articulated in the first ten amendments of the Constitution. Our Rights supersede and are superior to government. These Rights are not subject to the whims of legislation and the Right to Bear Arms would still exist even if the Second Amendment was absent or was removed from the Constitution.
