Lyon County deputies arrest man for domestic dispute, pointing firearm at officers
On October 13, 2023, at approximately 1650 hours, Lyon County Sheriff's Office Deputies were dispatched to a residence on Starlite Drive in Fernley, Nevada in reference to a domestic disturbance.
Upon arrival, a responding Deputy advised, via radio, that a male subject came to the door of the residence and pointed a firearm towards the Deputy.
The Deputy gave the suspect commands to drop the firearm. The suspect refused to follow commands and shut the door, remaining inside the residence. The suspect later opened the door and advised that the firearm he had was a pellet gun.
However, at the time, the Deputy had been placed in reasonable apprehension of bodily harm, due to the suspect pointing the unidentified firearm at him.
A perimeter was established around the residence and Deputies gave verbal commands for the suspect to exit the residence. Contact was made with the suspect and he was extremely uncooperative and belligerently yelling at law enforcement personnel on scene.
After a short period of issuing verbal commands, the suspect exited the front door of the residence and continued yelling at law enforcement. It was determined he was unarmed at that time, and a team of law enforcement personnel was able to rush the suspect and take him into custody without further incident.
The suspect was identified as 62 year-old Fernley resident, Mitchell Levey. Mitchell Levey was subsequently booked into the Lyon County Jail on the following charges:
Assault with a Deadly Weapon upon a Protected Person (Felony)
Assault upon a Protect Person (Gross Misdemeanor)
Obstructing (Misdemeanor)
• Resisting a Public Officer (Misdemeanor)
