Carson City man arrested for attacking fellow prisoner, made several phone calls boasting of the crime immediately after
A 39-year-old Carson City man was arrested at the Carson City Jail for allegedly battering another prisoner.
According to the report, Aubrey Avery was arrested on felony battery by a prisoner which occurred on April 28 at the Carson City Jail.
According to the arrest report at around 1 p.m. another inmate notified the control deputy that he needed to be moved out of male general and pointed at his eye, which led deputies to believe that a fight had occurred.
At 1:30 p.m. deputies brought the inmate into a room to be interviewed. He stated that the day before he was struck by a prisoner in the face three times inside male general. Deputies noticed two bruises under the inmates eye and some swelling on his left cheek.
Deputies reviewed the video from male general. At approximately 6:18 p.m., Avery was seen on camera approaching the inmate who was sitting on the south side of the pod in front of the TV. Avery tapped the inmate on the shoulder and motioned for him to follow.
The two inmates walked into the pod that Avery is housed in. Avery proceeded to shut the door and according to the report, “it is apparent that an alteration takes place.” One minute later, both males are seen exiting the pod in the video, according to the report.
Deputies spoke to three additional inmates who confirmed that an incident had occurred inside the pod, and that the inmate who had hit the other inmate was wearing black and white Nike Air shoes.
In Avery’s medical note it is stated he was approved by the jail APRN to wear his personal shoes which are black and white Nike Airs, according to the report.
The next day, deputies accessed Avery’s phone call records. He made a phone call to a woman at approximately 6:23 p.m. directly after the fight stating “I punched a *** out!” (redacted by deputy report) to which the woman replied “Good, you knocked him out. He deserved it.” During the phone call both referenced the inmate’s first name throughout two separate phone conversations in reference to the fight, according to the report.
