Carson City arrests: Man jailed for using pepper spray on gas station clerk

A 28-year-old man was arrested Sunday for suspicion of battery with a deadly weapon, possession of an unlawful amount of tear gas and other alleged offenses, according to a Carson City Sheriff's Office booking report.

Andrew Toland was arrested at 8:50 p.m. following an investigation after a North Carson Street gas station clerk was pepper-sprayed in the eyes. Toland also was arrested for suspicion of misdemeanor obstruction and two counts violation of a suspended sentence.

According to the booking report, deputies responded to the gas station in the 1300 block of North Carson, where the clerk advised he had been sprayed with pepper spray.

The clerk told deputies he heard a commotion outdoors, stepped outside and observed a male on a scooter screaming at a customer pumping fuel into her vehicle. The clerk confronted the man, who pulled out a can of pepper spray and sprayed it into his face, according to the report.

The suspect was described as wearing a colored jacket, dark clothing, with a backpack and riding a "Razor" style scooter. The same person had been seen several times earlier riding back and forth on the scooter. During the course of the investigation including interviews with others, deputies learned the name and address of the suspect.

Deputies located the green "Razor" scooter outside an apartment. Deputies knocked on the door where the man opened it and was detained. He was read his Miranda warning and was asked if he had used the pepper spray. The man initially said no and had no idea what the officer was talking about. After the suspect was told there was video of the confrontation with the female pumping gas, he confessed and said he had a can of pepper spray inside.

The suspect told the deputy he was riding his scooter past the gas station when a woman who was getting gas began doing magic tricks against him. He said he confronted the woman for doing such magic tricks, and that's when the clerk came up to him and pushed him to the ground. He said he pepper sprayed the man because he got into his "bubble," the arrest report states.

Deputies located a 5-ounce can of Police Magnum Oleoresin Capsicum (OC pepper spray ) that was taken into evidence. He was arrested for suspicion of battery with a deadly weapon, use of tear gas in the commission of a crime, possession of an unlawful amount of pepper spray (more than 2 ounces) obstruction, and two charges of violation of a suspended sentence. Bail: $34,912.

In other arrests:
— A 24-year-old Mound House woman was arrested Feb. 13, 6:57 a.m. for suspicion of misdemeanor domestic battery.

According to the booking report, the woman allegedly repeatedly punched her boyfriend while he drove his vehicle from College Parkway to Highway 50 East, coming to a stop so that he could contact dispatch.

Officers observed red marks on the right side of his face, and behind his ear, right cheek and a red lump on the side of his forehead, consisted with being struck from the right side while he was driving. The woman, who had a strong odor of alcohol, denied making any physical contact and that she didn't do anything to him. She was arrested. Bail: $3,137.

— A 63-year-old Hawaii man was arrested Feb. 12 for suspicion of DUI and driving the wrong way on a 1-way highway, according to a sheriff's office booking report.

At around 11:17 p.m. a deputy observed the driver in the northbound lane of North Carson Street going southbound. The vehicle stayed in the northbound lane for a short while until turning eastbound on Hot Springs Road and then stopping at the intersection of Hot Spring and Sage Street.

A deputy made contact with the driver, and asked how much he had to drink that night. The driver did not answer the question, neither admitting or denying consuming alcohol. He was asked to do field sobriety tests.

During the interview portion he stated he had an unspecific amount of beer at a casino earlier in the evening. During the tests he showed signs of impairment and was arrested for suspicion of DUI. Bail: $1,224.

— A 36-year-old Sparks woman was arrested Tuesday, Feb. 14 for suspicion of felony possession of a stolen vehicle.

Samantha Leigh Stewart was taken into custody at 8:27 p.m. According to a booking report, a deputy was dispatched to the 1300 block of North Carson Street for a suspicious circumstance. Dispatch received a call that a male subject had hit the side of a U-Haul and may have smashed one of the windows.

A deputy located the U-haul, which had a shattered rear passenger side window. The deputy ran a registration check on the vehicle. Dispatch advised the van status was showing stolen out of the Reno Police Department. RPD was contacted and the van was confirmed stolen, the report states.

Another deputy made contact with the investigating deputy who advised that earlier in the day they had made contact with the female, Samantha Stewart. The van had not yet been reported stolen, the report states.

The van was parked in front of a motel room where the woman was residing. The officer made contact with the woman, who stated she has been in contact with U-Haul and had until tomorrow to return the van. However, after speaking with management, it was confirmed the woman was due to return the van days ago. She was arrested for suspicion of possession of a stolen vehicle. Bail: $20,000.

— A 33-year-old man was arrested early Monday for suspicion of disturbing the peace. The man allegedly pounded on the walls and shouted insults at his neighbor. On two earlier interactions, the man had admitted to hitting the walls and shouting at his neighbor, who was trying to sleep and had to be up at 4 a.m.

When the officer arrived a third time, he could hear the man swearing and pounding on the walls. He was arrested for disturbing the peace. Bail: $192.
