Legal opinion released on Carson City Board of Supervisors election vacancy
Back in August, I wrote about a conversation I had with DA Neil Rombardo about how the election could change the composition of the Carson City Board of Supervisors.
With termed-out supervisors Robin Williamson and Pete Livermore running against each other for the District 40 Assembly seat, the winner will have to resign from the board the next day because Assembly members take office immediately upon election. That means that a replacement must be named within 30 days to fill that open position for the 32 days left in the unfinished term.
Rombardo also said at the time that if the board voted to appoint the winning supervisor candidate to fill the remainder of the term, it would count against them for term limits. That set up a situation where the board might have to pick someone else to fill in for only a little more than a month before the new supervisors would be sworn in.
Today, I was forwarded Rombardo's official opinion on the matter, along with the legal rationale. But there has been a change from that previous position about the term limits. The DA now concludes that a newly elected supervisor could be picked to fill the remainder of the term and still be able to serve for two full terms.
