Carson City sheriff's arrest log: Man jailed after firing gun inside Long Street apartment

A 26-year-old Carson City man was arrested early Saturday morning after he allegedly fired a gun inside an East Long Street apartment after an argument with his girlfriend, a Carson City sheriff’s deputy said.

David Wesley Johnson was booked on the felony charge and two misdemeanor charges, possession of dangerous weapons, brass knuckles, and possession of drug paraphernalia. According to the arrest report, deputies were called to the area of East Long Street at 11:06 p.m. Christmas night for a report of shots fired in the area and a female screaming in distress.

Officers arrived and saw a man running out of the apartment complex. They stopped him and asked him where he was coming from. The man, who had a strong odor of alcohol on his breath, said he didn’t know which apartment he had been in. He also said he didn’t hear any gunshot. The officer asked him who he had been with. He replied his brother, David Johnson, and the man’s fiancee, the arrest report states.

Deputies then spoke with neighbors who said they also heard a single gunshot coming from the apartment on East Long Street. Officers attempted to make contact and knocked on the door multiple times. Officers then attempted to make contact through a sliding door, and announced their presence and that all the residents should come out with their hands in plain view.

After multiple requests, two men stepped out including the suspect. Officers entered the apartment to ensure there wasn’t anyone in distress inside. In plain view officers could see a glass pipe commonly used to smoke marijuana and brass knuckles.

The officer spoke with the men they had detained and asked who the woman was who was screaming. The suspect said it was his fiancee but she had left before officer arrived. A deputy asked if the woman was injured. The suspect replied she was not. The officer asked for the woman’s phone number so they could check on her safety. The suspect refused to give officers the woman’s number or any other information. The officer asked the other man if he knew anything. He said he didn’t.

Approximately 30 minutes later, the brother of the suspect returned to the apartment with the woman. She said she was not injured and confirmed she was in the apartment with the suspect and two other men when she and her boyfriend got into an argument. She said she went to bed and then heard the gunshot. She said she left the apartment because she didn’t want to be “caught up in David’s bulls***” because she has a three-year-old child and didn’t want Child Protective Services to take her daughter away from her, the arrest report states.

The officer asked if the suspect had any guns. She said he owns a .357 pistol, an AR15 rifle and an AK47 rifle. She gave officers consent to search the apartment and gun safe in the bedroom. Officers found the weapons, one with a spent cartridge in the chamber, along with two pairs of brass knuckles, as well as a speed loader for a revolver on the dining room table and a glass marijuana pipe.

The suspect was arrested and read his Miranda rights. He declined to speak. While in the pre-booking area he told the deputy “I’m sorry for being a dumb ass,” the arrest report states. Bail: $23,637.

According to the booking report, the intoxicated man was inside a residence that he was ordered to stay away from by the Department of Alternative Sentencing. According to the arrest report, officers responded to the area to locate two stranded subjects. Dispatch advised the man had a felony fugitive from justice warrant from a court in Mississippi.

— A 57-year-old Carson City man, David Ray Kirkman, was arrested Thursday, 6:17 p.m. in the area of Curry and Washington streets on felony suspicion of DUI with a prior conviction, and misdemeanor charges of improper turn, and not using a turn signal.

According to the arrest report, deputies were called to the area of Carson and William streets to intercept a driver that was reported to possibly be under the influence. Several citizens had called police and stated a Ford Ranger was traveling westbound on William Street and could not maintain a lane of traffic.

A deputy found the suspect vehicle stopped in the southbound turn lane on westbound William Street. There were three vehicles behind the suspect, all flagging the officer down and pointing to the vehicle. One driver rolled down his window and stated “DUI, he’s DUI,” according to the arrest report.

The deputy made a traffic stop and spoke with the driver who had slurred speech and red, watery, bloodshot eyes. He denied drinking alcohol and later changed his story, admitting to drinking one beer in Dayton.

The deputy asked the man if he would participate in field sobriety tests. Because the ground was icy, and snow was falling, and because he didn’t complete the horizontal gaze nystagmus test effectively, the officer decided to not conduct the physical tests for safety reasons. He administered the preliminary breath test with a reading of .207. He was taken into custody. At jail he provided breath samples of .163 and .152. A check with dispatch revealed his criminal history with a prior DUI conviction in 2009. Bail: $10,179.

According to the arrest report, deputies were dispatched at 1:49 a.m. to the 1700 block of Rhone Street in reference to a hit and run accident report. The victim advised his vehicle was struck from behind and dispatch could hear a confrontation on the phone. During the dispute, the suspect allegedly punched the victim in the face and broke his vehicle window and then drove away in a 2007 red Audi.

At 5:10 a.m. a deputy advised he had located the vehicle near the roundabout at Fifth Street and Fairview. The deputy initiated a traffic stop in the 1800 block of Fairview and another deputy arrived, who informed the suspect his vehicle was involved in a traffic incident earlier.

The man denied being involved. He had a strong odor of alcohol coming from his breath and red, watery eyes. He admitted to drinking quite a few beers that night. He matched the description provided by the victim and a witness across and was arrested. He was read his Miranda rights and he advised he understood his rights and would speak. He submitted to four sobriety tests, failing all tests. He advised he would participate in an evidentiary breath test. Bail: $3,637.

According to the arrest report deputies were dispatched to a residence for a report of harassment and threats. The victim called police and stated her ex-boyfriend was sending messages via cell phone that threatened bodily harm to her and her 15-year-old daughter.

Deputies met with the victim who provided the cell phone that contained several vulgar, threatening and violent text messages from the ex-boyfriend that were made from Dec. 23 through Dec. 25.
Officers located the man at a Roop Street address. He denied sending any messages and then stated “I sent them to her mom, not to her,” the arrest report states.

The man was arrested and was argumentative with the officer. He was taken to jail. His cell phone was seized as evidence. The victim said the man did not have a receipt. The victim stated he had reviewed the store video and observed the suspect entered the store without any items and that he observed the man take two items from the store shelf and bring them to the register for a refund and that he did it while holding a small child in his arms.

The victim told the officer that he asked the suspect to come to his office regarding the alleged crime. The man began to walk toward the store main doors. The victim said he attempted to control the man by grabbing his arm.
