Officers spoke with Slater who was in the driver’s seat and is the registered owner of the vehicle. He smelled of alcohol and an open bottle of Wild Turkey bourbon was on the front passenger floorboard, the arrest report states. The officer asked for the man’s identification and to step out of the vehicle. Dispatch advised the man was an ex-felon and his driver’s license was revoked.
The man refused to take a series of field sobriety tests. He was read the Nevada Implied Consent and was informed that because he has a prior felony DUI conviction there would be a blood draw. The man, who had been drinking, said, “well let’s go to jail.” He told officers he could have left the scene and deputies wouldn’t have been able to find him.
