Jury reaches guilty verdict in Lyon County child molestation case
An 81-year-old Yerington man was found guilty of three counts sexual assault on a child, one count of lewdness with a child under 14, and one count of open and gross lewdness, following a week long jury trial in Lyon County.
Arlyn David Hogarth was found guilty by on Oct. 18, 2017 following the trial in Yerington, said Lyon County District Attorney Stephen Rye. He faces a sentence of life in prison with parole eligibility of 5 to 25 years.
Hogarth was charged with sexually abusing two girls during two different time periods. The case was investigated by the Lyon County Sheriff’s Office.
“The victims in these cases suffer first with the abuse and then having to relive the abuse in a criminal trial. The strength and courage of the victims in this case is remarkable," said Rye. "Because of their courage, the prosecution could move forward and the jury could render the guilty verdicts in this case. We often overlook the sacrifices that are made by victims and the difficulty in bringing these offenders to justice.”
The Third Judicial District Court will sentence Hogarth on a date to be determined. On two of the sexual assault counts, Hogarth faces a possible sentence of life in prison with parole after 20 years, or a definite term of 20 years, with parole eligibility after 5 years.
On the lewdness with a child charge, he faces life in prison with parole eligibility after 10 years. On one sexual assault charge he faces life in prison with parole after 25 years. On the open and gross lewdness charge he faces up to one year in the Lyon County Jail.
