RPD Report: Dayton man had marijuana in system, at fault in June fatal crash with NHP Trooper
A Dayton man who died in a June 5, 2017 crash that involved a Nevada Highway Patrol trooper on US50 in Lyon County failed to maintain his lane when operating his 1999 BMW and is found to be at fault in the crash, according to Reno Police Department’s M.A.I.T. investigators in their final report released Wednesday.
Dayton resident Jack Mynear, 75, died in the crash. According to RPD investigators, his BMW crossed over the center median 5 miles east of Dayton and began traveling eastbound in the westbound shoulder. His vehicle struck head-on a marked NHP vehicle that was parked in the westbound shoulder. The NHP trooper's dash camera video confirmed witness accounts of the crash.
The toxicology report found that Mynear had 31 ng/ml of marijuana THC in his blood. NRS 484C.110 states that anything above 2 ng/ml of marijuana THC in the blood is a violation of the law, said M.A.I.T. investigators.
Jack Mynear died at the scene. There are no criminal charges being sought.
The NHP trooper sustained moderate injuries and was hospitalized.
