Carson City arrests: Man booked for alleged sex crimes involving child
A 22-year-old man was arrested Friday for suspicion of possession of promotion of sexual performance conduct, child pornography and other alleged sex crimes, according to a Carson City Sheriff's Office report.
Donivan Elijah Bailey was taken into custody following an investigation that began last month. He was also booked for suspicion of felony lewdness with a child under 16 and child abuse/sex exploitation.
According to the arrest report, Carson City Sheriff's Office detectives began an investigation regarding a child exploitation report involving a 5-year-old. The child's uncle allegedly used his black cell phone to take pictures of the victim's private parts, according to the booking report.
Following interviews, a detective applied for and was granted a search warrant at the man's residence in the 3300 block of Highway 50 East. The warrant was served June 30. The warrant was to locate Bailey's phone and all electronic devices that store data. The warrant was to search his phone for pictures of the victim and for child pornography, the arrest report states.
Law enforcement knocked on the man's door, in which the suspect answered. He had a black cell phone in his hand while speaking with officers. A deputy gave him a copy of the warrant and explained what it was for, the report states.
The suspect said he understood. The officer asked the man for his phone, which he gave it with hesitation. The deputy took custody of the phone and was shown how to unlock it. Officers also located several electronic devices including four tablets, a laptop, Playstation, and an Xbox. The man cooperated and gave several passwords for devices and accounts, the report states.
On July 1 a criminologist completed a forensic download of the phone and found evidence of photographs involving the victim in which the victim had described to investigators the incident and the photos that were taken of her.
Bailey was contacted and agreed to be interviewed at the sheriff's office. He was emotional and began to cry, explaining that he misses his family, who he had not been able to talk with since the accusation of photographing the child. He told the detective he was distraught he was accused of taking photos of the child's private area, according to the report.
The investigating detective asked the man if he had taken a picture of the victim's "privates." The man replied no. He was shown some of the pictures that were found stored on his phone. He recognized himself in the pictures with the victim. He was shown close-up pictures and he stated he took the photos. He was asked if he did anything else to hurt the child. He said no. He would not tell the officer why he took the pictures.
The interview concluded and the man was arrested. Bail: $100,000.
