Carson City sheriff’s arrest log: Two jailed after graffiti spree

Two men were arrested early Monday on multiple misdemeanor charges including graffiti after a number of walls had been tagged overnight, a Carson City sheriff’s deputy said.

Arrested was a 27-year-old Carson City man in the 3100 block of Imperial Way. He faces misdemeanor charges of DUI, driving on a revoked license, open container as well as graffiti. Also arrested was a 22-year-old Carson City man on misdemeanor graffiti and violation of probation charges.

According to the arrest report, an officer patrolling the area of Roop and Winnie observed graffiti on a wall with blue spray paint at 12:23 a.m. The vandalism appeared to be new because it wasn’t observed earlier in the evening. Another deputy found two more locations with similar vandalism and colors.

Dispatch advised an anonymous person called to report graffiti in the 3400 block of Imperial Way and said they saw a gray Nissan Xterra at the location that appeared to be related. The officer responded to the area and located more graffiti on the north side of an apartment complex.

As the officer was photographing the vandalism he saw a gray Nissan Xterra approach the apartment complex. The driver appeared to have seen the patrol car and left at a high rate of speed. The officer followed the vehicle and conducted a traffic stop in the 3100 block of Imperial Way.

The officer made contact with the driver and could smell a strong odor of alcoholic beverage. The officer could see an open case of beer in the back seat. The driver told the officer he had consumed three beers. While speaking, he could see that the passenger in the right front seat had blue paint on his right hand, the arrest report states.

The passenger was asked to get out of the car. He provided a voluntary breath test that registered .230. Department of Alternative sentencing advised he was on probation with a “no alcohol” clause and was a gang member. He was taken into custody.

The 27-year-old driver of the vehicle was then asked to get out of the car. He agreed to voluntarily perform standardized field sobriety tests and performed them unsatisfactorily. He had a preliminary breath tests of .132 and had been driving on a revoked driver’s license, the arrest report states.

During inventory of the vehicle a deputy found a blue spray paint cap that matched the color of the graffiti locations and an open beer can directly behind the driver’s seat.

The driver, a known gang member, was read his Miranda warning and agreed to speak. He was asked why they were spray painting graffiti. The driver initially denied having any knowledge of it. The officer told him he found blue paint on the passenger’s hands, a blue spray paint cap in the car and that the vehicle was observed in the area where there had been fresh spray paint.

He admitted to being with the 22-year-old passenger when he spray painted the described areas. He said he had just been fired from his job and was “acting out.” He apologized for helping the passenger with the graffiti. Bail for the 27-year-old: $2,158. Bail for the 22-year-old $3,637.
