Carson City man jailed for allegedly shooting pistol into the air, obstructing officer
A 41-year-old Carson City man was arrested early Thursday for suspicion of being a prohibited person in possession of a firearm, discharging a firearm in the city limits and other offenses, according to a sheriff's office arrest report.
Gary Wayne Carr was taken into custody at 12:47 a.m. following an incident at a Hot Springs Road residence. He was also arrested for suspicion of being in violation of department of alternative sentencing conditions and obstructing.
According to the booking report, deputies responded to an apartment in the 600 block of Hot Springs Road for a report of shots fired.
A reporting party advised the suspect was wearing construction clothes. Deputies approached the east side of the complex and was able to hear a male subject yelling toward the back. Deputies walked toward the east end and located the suspect, and ordered him to come down from the stairs. Carr didn't follow commands and was attempting to enter an apartment. A female subject opened the door but wouldn't allow Carr inside, the report states.
Carr was given multiple commands to come down the stairs or a pepper ball gun would be deployed to gain compliance. The man continued to disobey commands by attempting to enter the apartment, the report states.
The man was given multiple lawful commands but wouldn't listen, the report states. He was hit by a pepper ball gun a few times and still wouldn't cooperate with commands. The pepper gun was deployed a few more times and Carr eventually was taken into custody, being verbally uncooperative as he was escorted to a patrol vehicle, the report states.
Deputies made contact with a reporting party who stated he went down to see his uncle, Carr, who was standing behind his vehicle in the parking lot and he appeared to be drunk and had a handgun in his hand.
The reporting party stated he was worried he was going to get shot and stated Carr kept waving the firearm around and, at one point, pointed the firearm at him for about 5 minutes.
The reporting party stated Carr became upset with him because he wouldn't let him get inside his car, then pointed the firearm in the air and shot his pistol three times. Another person, also a relative, confirmed hearing three gunshots.
Deputies read Carr his Miranda warning, in which he kept interrupting the officer and wouldn't listen, asking what he was charged with. Deputies canvassed the area, but no firearms or shell casings were located, the report states.
Deputies located Carr's vehicle and applied for a search warrant for his vehicle in an attempt to locate a firearm and shell cases. The warrant was granted and officers located a firearm box that was booked into evidence.
Due to the reporting party statements and being witness to the shooting, and another hearing rounds of gunshots discharged, Carr was booked for being in possession of a firearm by a prohibited person (he had been convicted of domestic battery in 2015), discharging a firearm within the city limits, violation of alternative sentencing conditions and obstructing an officer. Bail: $24,049.
