Felony assault arrests keep Carson City officers busy during Nevada Day weekend

Carson City officers arrested five people on Saturday with two facing felony assault charges after a fight at the former Toads Bar in Carson City.

Officers responded to the bar in the 300 block of William Street at 10:22 p.m. where they observed two men dragging, kicking and punching a man near the front entrance. Arresting officers ordered the men involved in the melee to the ground, which they complied, according to the arrest report.

All were intoxicated, with the man who was being beaten appearing semi-conscious, the report stated. Officers located a fourth male exiting the bathroom, his shirt ripped and face bloodied and appeared to have been involved in the fighting, the arrest report states.

Carson City Sheriff Ken Furlong and Sgt. Pullen arrived on scene and assisted the arresting officers in detaining all the subjects. The man who was being beaten then became uncooperative and officers had to wrestle his arms out from under his body to place him in handcuffs, the arrest report stated.

According to witnesses, the men involved were all playing pool. The man (who officers had seen being beaten upon arrival) reportedly urinated in his pants and it was pointed out by a woman, identified as Desiree Avilia, 29, of Carson City.

Witnesses said the man who urinated himself then became aggressive to Avila and a fight ensued involving the man with the stained pants and another man. As the fight escalated between the two men, two other men became involved in the altercation, including Michael Menke, 30, of Carson City. During the fight, the woman reportedly used a pool cue to strike at people in the bar "numerous times" while Menke began chucking cue balls at two others fighting, the arrest report stated. Avila reportedly struck the man who urinated himself, knocking him out, the report stated.

The five were taken into custody and sent to jail. After being read her Miranda rights, the woman told authorities she didn't hit anyone with the pool cue. When advised there were at least two witnesses reporting she had, she told officers "What else was I supposed to do? I'm a woman and they are men," the arrest report states.

Avila faces a battery with deadly weapon charge, a felony. Menke, who reportedly threw the cue balls during the fight, faces a felony battery with deadly weapon charge. Each had bail set at $30,000. Three others, including the man who urinated on himself, all face misdemeanor charges associated with the fight.

In other arrests:

— A Minden man faces felony charges of battery on a peace officer and battery with a deadly weapon in a Oct. 27 incident at a casino in the 5000 block of South Carson Street. Officers arrested Todd Fruth, (age not given) who faces the charge.

According to the arrest report, officers responded to the casino at 8:30 p.m. in reference to an uncooperative intoxicated man. Deputies were advised that Fruth was unruly and was sitting outside the casino near a railing. Officers report finding him hunched over with his hood up and his hands in his pockets. Officers told the man to remove his hands from his pockets. The man ignored the officers after officers asked several times, the arrest report stated.

Fruth then began to scream and curse at the officers, telling them to leave him alone and began walking away from them. Both officers said they thought that the man had a concealed weapon his jacket because he would not remove his hands from his pockets. One officer drew a firearm and the other drew a Taser and aimed it at Fruth who then took off running, the report states.

During the chase Fruth then reportedly picked up a rock the size of a baseball and chucked it at the officer hitting him in the knee, the arrest report states. Fruth stood there after throwing the rock and kept his hands in his pockets. A third deputy arrived and tackled the Fruth to the ground and placed handcuffs on him. He was taken to jail and faces charges of battery with a deadly weapon, battery on a peace officer, both felonies and misdemeanor disorderly conduct.

— A Carson City man faces a felony assault with a deadly weapon charge after allegedly punching a man in the face and throwing a rock at his vehicle. The incident happened at 8:43 p.m. in the 1400 block of East William Street at Walgreens on Saturday, Oct. 27.
Jason Michael Fisher, 25, was arrested and faces the felony assault charge. According to the police report two witnesses stated the male victim was assaulted by two men, in which the victim was punched in the face. The two men then got into a black Mazda and took off. Witnesses took down the license plate number and it came back to an address to the 1600 block of Parkland, according to the arrest report.
Officers went to the home the vehicle was registered to and spoke with the two suspects and the owner of the vehicle who said she was inside the car during the incident and that the men told her they had punched a man while at Walgreens.

Fisher, who faces the assault with a deadly weapon charge and a misdemeanor charge of causing damage to the victim's car, refused to speak with officers. A 28-year-old Sparks man faces a misdemeanor battery charge as well as having a misdemeanor failure to appear in court warrant for his arrest. He told officers that Fisher threw the rock at the victim's car, smashing the windshield, but denied that Fisher or he ever punched the victim in the face.

— Those arrested are innocent until proven guilty in a court of law.
