Jury finds Silver Springs man guilty of shooting at Lyon County Sheriff's Office deputy
After three days of trial, a jury found a 33-year-old Silver Springs man guilty of resisting a public officer with a deadly weapon and assault with a deadly weapon, both felonies.
Florencio Brito was found guilty May 21 at the conclusion of the Third Judicial District Court trial in Yerington. Orrin J.H. Johnson, Senior Deputy District Attorney, and Damian Sinnott, Deputy District Attorney, prosecuted the case for the Lyon County District Attorney.
Mr. Brito was convicted of these crimes for aiming and shooting a firearm at a Lyon County deputy sheriff during the course of an investigation. The State of Nevada Department of Public Safety, Investigations Division, handled the investigation in the case.
Sentencing is scheduled for July 13, 2015, at the District Court in Yerington. Mr. Brito faces a maximum possible sentence of eleven years (five years for the resisting charge and six years for the assault with a deadly weapon charge) in the Nevada Department of Corrections.
“Peace officers put their lives on the line every day and are often faced with dangerous situations,” said Stephen Rye, Lyon County District Attorney. “Threats and attacks on peace officers cannot be tolerated, and will be dealt with seriously. As a civil society, we cannot allow individuals to threaten or use force or violence against police officers.”
