According to the booking report, deputies responded to a casino parking lot where there were multiple reports of a man driving around the parking lot intoxicated. Deputies made contact with the driver and occupant Kirkegaard. While speaking with the driver, the officer could smell an odor of alcohol coming from inside the vehicle.

The man was asked to exit the vehicle, where he stated no. After a third time of telling the man to exit the vehicle, a deputy opened the door and ordered him out, which he complied. The woman told the deputy she had just been in an accident on the northbound on-ramp to I-580. When she was asked if she reported the incident she replied she did not report it. A deputy responded to the area and observed fresh damage to one of the signs present.
