Carson City tavern faces $10,000 or more fine for twice failing to adhere to COVID regulations

A second complaint was filed against Bette Larsen, owner of Timbers Saloon in Carson City, by the Nevada Gaming Control Board earlier this month.

The complaint alleges that, for the second time, Larsen has failed to adhere to health mandates by requiring that patrons and employees wear face coverings and adhere to social distancing, as stipulated by the gaming board.

Larsen has held a gaming license since 1991 for Timbers, according to the complaint, and therefore falls under the jurisdiction of the Nevada Gaming Control Act and must comply with the Gaming Control Board’s regulations.

According to NRS 463.0129, the gaming board has the full authority to fine any licensed individual who goes against the regulations of the board.

According to the complaint, on May 5, 2021 the board received a complaint that both employees and patrons at Timbers were not wearing face coverings and were not practicing social distancing, despite an ongoing mandate that both needed to be observed by gaming establishments.

During an inspection that same night, a board agent observed between 20 to 30 patrons inside the bar who were not wearing face coverings and were not practicing social distancing. The agent also noted there were three employees behind the bar who were not wearing face coverings.

When the board agent went to take pictures, one of the employees behind the bar covered his mouth and nose with his face covering, according to the complaint.

On May 10, a board agent contacted Larsen and informed her of the violations.

This was the second complaint Larsen faced for Timbers. The first was filed in October of 2020, when it was alleged that a bartender and patrons at Timbers were not wearing face coverings or practicing social distancing, during a time when both were required by mandate.

In November 2020, the commission accepted a settlement for the October 2020 compliant as Larsen agreed to pay a fine in the amount of $5,000, and agreed to a condition requiring a key employee application filed no later than Jan. 18, 2021.

A key employee application, which would ensure a staff member be responsible for upholding regulations when Larsen was not present, was not filed until Jan. 21. An application for a new restricted gaming license was submitted by a new entity, The Timbers LLC dba Timbers Saloon, for which Larsen currently holds a restricted gaming license.

According to the complaint, during Feb. 2007, Larsen formed The Timbers LLC, and sometime between 2007 and 2018, transferred her licensed gaming operation to The Timbers, LLC. However, the gaming board never approved the transfer, as it never received any applications to do so.

The complaint further alleges that Larsen has filed forms since 2018 that she is the 100 percent owner of Timbers, without any intermediary business entities, which is a violation of regulation.

The Nevada Attorney General’s office has recommended a $10,000 fine for the second offense.

However, Larsen could be facing substantially more fines, as outlined by NRS 463.310(4) which states:

(d) Fine each person or entity, or both, which is licensed, registered, found suitable or found preliminarily suitable pursuant to this chapter or chapter 464 of NRS or which previously obtained approval for any act or transaction for which Commission approval was required or permitted under the provisions of this chapter or chapter 464 of NRS:

Not less than $25,000 and not more than $250,000 for each separate violation of any regulation adopted pursuant to NRS 463.125 which is the subject of an initial or subsequent complaint; or
 (2) Except as otherwise provided in subparagraph (1), not more than $100,000 for each separate violation of the provisions of this chapter or chapter 368A, 464 or 465 of NRS or of any regulations adopted thereunder, which is the subject of an initial complaint and not more than $250,000 for each separate violation of the provisions of this chapter or chapter 368A, 464 or 465 of NRS or of any regulations adopted thereunder, which is the subject of any subsequent complaint.

A man residing in Carson City was arrested in connection with murders in Gardnerville and Washoe County, according to sheriffs from Reno, Douglas County and Carson City.

On Saturday, Jan. 19, Wilbur Ernesti Martinez Guzman, 19, who resides in Carson City, was arrested in connection with the murders in Douglas County and Washoe County.

According to Washoe County Sheriff Darin Balaam, law enforcement agencies are confident there is enough evidence to link Guzman to all four homicides.

UPDATE 1:02AM: Multiple news sources, including South Tahoe Now and KOLO TV Channel 8 News Now, are now reporting that a person in connection with the investigation into a double homicide in South Reno is in custody, Washoe County Sheriff's spokesman Bob Harmon reportedly told the sources.
It was reported earlier that a connection had not yet been made with the information at hand.

Welcome to your weekend, Carson City. You have a brief reprieve from the cold and stormy weather Saturday as the National Weather Service forecast calls for partly sunny skies and a high temperature into the 50s.

Due to verified reports involving the likelihood of stray bullets entering into populated areas originating from the discharge of firearms at the Carson City Rifle and Pistol Range, a temporary operating schedule was implemented along with the increased presence of Range Safety Officers made available by the Carson Rifle and Pistol Club, the city’s non-profit partner for the operation of the range.

The Washoe County Medical Examiner’s Office has released the names of a couple killed in south Reno. 81-year-old Gerald David, a former Reno Rodeo President, and his wife, 80-year-old Sharon David, were found dead in their home January 16, 2019. Both had been shot to death.

On Thursday, Jan. 24 at 8:30 a.m., there will be a special workshop of the board of supervisors that is open to the public to discuss objectives and goals of Carson City.

The meeting will be held at Adams Hub for Innovation, located at 111 W. Proctor Street.

The January Carson City School Board Meeting is scheduled for Tuesday, Jan. 22 beginning at 6 p.m.

UPDATE: 1/18/19 at 3:15PM: According to a story in the Reno Gazette Journal today, the elderly couple found dead in their South Reno home Wednesday have been identified by friends as Jerry and Sherri David. Jerry David was a former president of the Reno Rodeo Association.
The identities of the elderly couple still have not been released by the Washoe County Sheriff's Office, which is leading the investigation into their deaths that have been ruled homicides.

An elderly man and woman died as a result of homicide at their south Reno residence after their bodies were discovered Wednesday, the Washoe County Sheriff's Office confirmed during a press conference.

The Lyon County Sheriff's Office received a report on 01/17/19 of a male subject trying to get a juvenile into his vehicle in the Sutro area of the Dayton Valley.

UPDATE: According to the Washoe County Sheriff Public Information Officer Bob Harmon, units are doing a search through Washoe Valley in an attempt to find evidence related to the La Guardia murders, but they are not following any specific leads.

“We have Search and Rescue volunteers and Washoe County Sheriff K-9 units that are searching through Washoe Valley right now,” said Harmon. “The search is related to the La Guardia investigation but there’s no specific lead they’re following. We’re doing the search just so we can leave no stone unturned, and to cover all the bases.”

Traffic in both directions on Interstate 580 through Washoe Valley, between the Bellevue overpass and Carson City, has been slowed to a crawl Friday afternoon after Nevada Highway Patrol and the Washoe County Sheriff’s Office closed left lanes in both directions while Search and Rescue members worked in the center median of the freeway running through Washoe Valley.

A 28-year-old Carson City man was arrested in the 2600 block of Saddlehorn Road Thursday morning on the charge of domestic battery after allegedly throwing his girlfriend on a bed in an attempt to get her to leave.

This wasn't the column I had planned to write. But so much social media drama has developed from the homicides in Gardnerville and South Reno that I think a public service announcement is necessary.

Good day Carson City. It is Friday, Jan. 18, 2019. Heading into the weekend it looks like the heavy stuff is out of the way weather wise. Today we'll see a slight chance of rain and snow after 10 a.m. with mostly cloudy skies and a high near 46. Saturday we are looking at partly sunny skies and a high in the low 50s.

The Carson City Parks, Recreation and Open Space staff have been busy bees (nod to Carson becoming Nevada’s first Bee City) and now the community has the opportunity to vote on their favorite names for three facilities.
