Additional sexual assault charges filed against Naomi Irion’s suspected killer
On Wednesday, the Lyon County District Attorney’s Office filed additional charges against Troy Driver, the suspected killer of 18-year-old Naomi Irion.
In addition to open murder, kidnapping, robbery, burglary of a vehicle, destruction of evidence and other charges already filed against Driver, the Lyon County District Attorney added felony sexual assault and a felon in possession of a gun.
Driver is being accused of raping Irion in addition to his other crimes.
The additional sexual assault charge is as follows:
Defendant did subject Naomi ion to sexual penetration, namely anal penetration, against her will or under conditions in which the defendant knew or should have known that the victim was mentally or physically incapable of resisting, all of which occurred somewhere between 1550 E. Newlands Drive, Fernley, Lyon County, Nevada, and near a rural portion of northern Churchill County, Nevada, the preparatory acts of which to accomplish said crime commencing at or near 1550 E. Newlands Drive, Fernley, Nevada, where the Defendant kidnapped the victim with the intent to commit sexual assault, and/or the concealment of said crime recommencing at or near 1550 E. Newlands Drive, Fernley, Nevada.
Irion was kidnapped in the early hours of March 12 from the Fernley Walmart parking lot while awaiting a shuttle to work, at which point an individual got into the driver’s seat of Irion’s car and drove away with her inside it. She was never seen alive again.
On March 25, her body was discovered in a rural grave in northern Churchill County. It was later determined she had been shot to death.
On June 29, Driver’s defense filed a motion to dismiss the murder charge, stating that because Irion was presumed to have been killed in Churchill County, the murder charge should not be prosecuted in Fernley, which is within Lyon County.
However, Lyon County DA Stephen Rye opposed the motion, stating that according to Nevada Law, if a crime is committed in tow or more counties it can be tried in any of the involved counties.
A preliminary hearing was set for July 5, but was postponed due to the motion to dismiss being filed.
Driver’s next appearance is scheduled for Sept. 13 in Fernley.
