Carson City arrests: Man seen 'asleep while driving' booked for suspicion of third DUI
A 29-year-old man was arrested Tuesday for suspicion of felony third DUI, according to a Carson City Sheriff's Office booking report.
Donald Leyba, a Carson City resident, was taken into custody on Tuesday afternoon in the 3700 block of South Carson Street. According to the booking report, a deputy was dispatched to South Carson Street in reference to a possible DUI driver.
The reporting party stated a Pontiac sedan was failing to maintain its lane and the driver had fallen asleep while driving. The reporting party followed the vehicle and watched as the male driver got out and stumbled to walk inside a small casino in the 3700 block of South Carson Street.
A deputy arrived on scene and made contact with the suspect, Leyba, who was the bartender and cashier at a small casino in the Eagle Station shopping center. The deputy asked him if he owned the Pontiac, which the man replied he did. The officer asked him if he had been drinking, and he stated he had not.
The officer asked him if he takes any medication, as the caller stated he was all over the road and falling sleep, the report states.
The man stated he takes medication but only at night. A deputy then spoke with the casino assistant manager who said they suspected the man showing up drunk but due to a medical condition they thought he might be on medications, the report says.
The deputy did not smell an odor of alcoholic beverage coming from the man's breath or person. The man was asked to step outside, which he did. The officer asked if he would be willing to do some tests and the man agreed.
He showed one clue of impairment on the Horizontal Gaze Nystagmus Test. The arrest report notes the suspect was unable to complete the walk and turn and one leg stand as he was not able to stand without falling over. The suspect provided a preliminary breath test with a result of .285, the report states.
Dispatch advised that the man is an ex-felon. Deputies did a criminal history check and learned the man had pled guilty to DUI third in 2004. He was taken into custody and submitted to a three series blood draw. Bail: $20,000.
